Federal Judge Directs DHS to Stop Arresting and Detaining Refugees in Minnesota

A federal judge in Minnesota has issued a significant ruling ordering the Department of Homeland Security (DHS) to cease the arrest and detention of refugees who are legally in the U.S. and awaiting permanent residency. This ruling directly impacts approximately 5,600 individuals across the state.

Judge John Tunheim found that DHS had been detaining individuals who followed the legal processes for admission and are currently adjusting their immigration status. He mandated that DHS release anyone being held under these circumstances and facilitate the return of anyone who was transferred out of state.

In a move to ensure the safety of those affected, the judge also directed Immigration and Customs Enforcement (ICE) to coordinate these releases to prevent individuals from being left outside in perilous winter conditions.

The court has established ongoing requirements for DHS, including the submission of detainee lists, regular status updates, and compliance with continued oversight as the case progresses. This ruling marks a critical step in protecting the rights of refugees and ensuring that lawful residents are treated fairly under U.S. immigration laws.

As the situation develops, advocates for refugee rights are expressing optimism about the ruling’s potential to safeguard vulnerable populations in Minnesota.
